The process for a basic divorce usually takes between five and eight months, but can be much longer if the divorce is highly contested. Mediation is an available tool that can be used to achieve a fair settlement for our clients. While we seek to resolve cases by settlement, we are prepared to do whatever it takes to make sure your divorce is resolved in a way that benefits you.

Property is apportioned an assumed 50-50 division, but can be modified based on the unique circumstances of each case. This applies to all marital assets, including debt, except property that was acquired as a gift or inheritance. We have extensive experience with property division and will work hard to ensure you receive the property to which you are entitled.

Child Custody and Visitation

While the impression is that courts favor the mother in custody cases, Missouri has a statute saying there is no gender preference for custody. In most cases, one party receives primary custody with another receiving visitation rights. You have a right to play a part in the life of your child and we will do everything in our power to make sure that is respected by the courts.

Missouri uses a mathematical formula to decide how much child support needs to be paid unless an agreement has been reached by the parents.
